Flat Fee Divorce
Hicks & Spector L.L.C. offers a flat fee option for certain types of divorce.
What is a flat fee for divorce?
You pay one amount at the beginning of the process and no further payments are needed. Each case varies in complexity. The attorney will quote the flat fee based on your individual case. Typically, the fee is between $2,500.00 and $3,500.00.
What is an uncontested divorce?
If you and your spouse have a full agreement on all terms of the divorce, we call this an uncontested divorce. This means you agree to divorce, agree on all terms regarding the children, support, property, and debts.
What does the flat fee include?
The flat fee includes preparation of the documents required by the court in a divorce. Those documents are the Petition, Parenting Plan, Marital Settlement Agreement, Child Support Order and Judgment of Dissolution of Marriage. We will prepare the required documents based on your agreement with your spouse, advise you as to your interests, and submit the documents to the judge. In some counties, you will need to make one appearance in court and that is included in the fee. The flat fee also includes the filing fees charged by the court. It does not include retirement plan documents, deeds, or other documents needed to transfer or divide property and debts.
What if my spouse does not agree?
The divorce becomes contested if the agreement falls apart. At that point, we will discuss the terms, costs, and process for a contested divorce.
